The YMCA of Owen Sound Grey Bruce welcomes your participation to support the vibrant and interactive spirit of the YMCA’s online community. Your comments, posts, messages and creative content are welcome on our online channels provided they encourage a respectful dialogue and comply with these Terms of Use and the YMCA’s mission, values and policies.

Privacy

Your privacy is important to us! If you provide any personally identifiable information (PII) to us through this Website, we will handle it according to what we say in our Privacy Statement.

Content Posted by the Public

You are responsible for the content you post to an online channel. The YMCA reserves the right to delete, remove, or not accept any content you submit that the YMCA believes, in its sole and unfettered discretion, is objectionable or that:

  • may be unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libellous, hateful or discriminatory;
  • impersonates any person or entity, or falsely states or otherwise misrepresents your affiliation with a person or organization;
  • may infringe another person’s intellectual property rights, including copyright;
  • is personal information published without the consent of the person to whom the information relates;
  • is unrelated to the content of the relevant channel;
  • links to material that is not directly related to the discussion on the relevant channel;
  • is commercial promotion or spam;
  • violates any law or material not in keeping with the safe and welcoming environment of the YMCA

While the YMCA will attempt to remove or edit any such objectionable content, it may not be possible to review all content immediately. Therefore, you acknowledge that all content submitted to an online channel expresses the views and opinions of the person submitting it and the YMCA bears no liability for the content.

The content you submit to an online channel remains your property, but by submitting it, you give the YMCA an ongoing license to use, reproduce, publish, display, distribute, transmit, modify, adapt and create derivative works of such content without payment of any compensation to you. You also waive any moral rights you may have in any content you submit. This license continues even if you stop using the relevant online channel. You also agree that you will respect the intellectual property rights of others when using online channels and for all content you submit to a channel.

Content posted by the YMCA

All content contributed by the YMCA to its online and social media channels, remains the property of the YMCA. In order to reproduce this content permission is required from the YMCA, except that the content may be reproduced in accordance with the Terms of Use.

Your Choice

You can access our websites and browse our site without disclosing your personal information, unless you choose to provide that information in order to register for YMCA programs or services.

We do collect the personal data you volunteer online, or when you make use of or register for our programs and services, in order to better meet your program, service and information needs. We may also collect personal information in order to satisfy legal, government and regulatory obligations.

We do not sell personal information we collect. We will not disclose your personal information to anyone else without your prior knowledge or consent, except when required by a government body or agency, or as permitted by law.

Social buttons

We use ‘social buttons’ to enable our users to share or bookmark web pages. These are buttons for third party social media sites and these sites may log information about your activities on the Internet, including on YMCA websites, social media platforms or other websites are not bound by our Privacy Policy. Please review the respective terms of use and privacy policies of these sites, and those of any applications you use to access them, to understand exactly how they use your information and to find out how to opt-out, or delete, such information.

Email Communications

We may also use tracking technologies to determine whether you have read, clicked on, or forwarded certain email communications we send to you so that we can make our communications more helpful and interesting. If you do not wish us to confirm whether you have opened, clicked on or forwarded our communications, you will need to unsubscribe, as it is not possible for us to send these emails without tracking enabled. Services and links of our Website

Because YMCA wants your website experience to be informational and resourceful, our website also provides a number of links to third party sites. The YMCA assumes no responsibility for the information practices of sites you are able to access through our site. We encourage visitors to review each site’s privacy policy before disclosing any personally identifiable information.

Confidentiality / Security

YMCA maintains physical, electronic and administrative safeguards that are appropriate to the type of personal information we obtain from you.

YMCA staff and volunteers having access to personal data are required to respect the confidentiality of personal information and handle it responsibly.

Electronic forms & communications

If you choose to contact YMCA staff using an email address, social media comment, text message or other electronic communication method, or if you choose to complete an online form provided on our websites, you may be asked to provide your name, email address or other personal information.

The purpose of collecting this information is to allow staff to respond to your enquiry or to evaluate individual web services. Only authorized staff will have access to the information provided and the information will only be used for the purpose it was intended.

If you participate in a YMCA evaluation survey, your information will be kept confidential and your name or personal contact information will never be associated with your responses without your consent.

We will only ask you to provide us with a method of contacting you (email, phone or mailing address) if you wish to be included in future surveys or wish to have us respond to you.

Use of and browsing YMCA online channels is done at user’s own risk. The YMCA shall not be liable for any damages arising out of your access to, or use of, or browsing online channels or uploading content to an online channel including, without limitation, damage to, your computer equipment or other property as a result of such use or access. Without limiting the foregoing, everything on YMCA online channels is provided to you “as is” without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of fitness for a particular purpose or non-infringement”.

Trademark

The official symbols of the YMCA of Owen Sound Grey Bruce may not be reproduced, whether for commercial or non-commercial purposes, without our prior authorization which you must receive in writing from us.

Terms and Conditions Specific to Event Registration

There may be specific terms and conditions posted on the registration pages for an event that are specific to that event. Please check the home page of the event when you register, to see if there are event-specific terms and conditions.

General

These Terms and Conditions shall be governed by and construed in accordance with the laws in force in the province of Ontario and the federal laws of Canada applicable therein, and any dispute arising hereunder shall be resolved exclusively by the courts in the province of Ontario.

The YMCA may update these Terms and Conditions at any time without notice to you. The YMCA may further, in its sole discretion, suspend or terminate access to its website or any of the services provided on its website, change or make improvements to any portion of its website information or services, without notice to you.
